Terms of Service

1. Agreement to Terms

By accessing or using the CTRL mobile application ("App") or website ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the service. These Terms apply to all users of the App and Website.

By using CTRL, you represent that you are at least 13 years old (or 16 if you are in the European Economic Area). If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Description of Service

CTRL is a personal development and goal-tracking application that helps users:

  • Set and track personal growth goals across five life pillars (Body, Mind, Craft, Wealth, Love)
  • Create and manage seasonal goal cycles
  • Build and track daily habits and tasks
  • Monitor progress through streaks and achievement tracking
  • Define personal vision and identity statements

CTRL is provided as a subscription service with some features available only to premium subscribers.

3. User Accounts

3.1 Account Creation

To use CTRL, you must create an account using Apple Sign-In or Google Sign-In. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breaches.

3.3 Account Termination

You may delete your account at any time through the App settings. Upon deletion, your data will be permanently removed within 90 days (see our Privacy Policy for details). We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to other users or to CTRL.

4. Subscriptions and Billing

4.1 Subscription Plans

CTRL offers subscription plans that provide access to premium features. Subscriptions are billed on a recurring basis (monthly or annually) and automatically renew unless cancelled.

4.2 Payment Processing

All subscriptions are processed through the Apple App Store. Your subscription will be charged to your Apple ID account at confirmation of purchase. Subscription pricing is available in the App and may vary by region.

We use RevenueCat to manage subscription status and entitlements. By subscribing, you agree to RevenueCat's processing of your subscription data.

4.3 Automatic Renewal

Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Cancellation

You can manage and cancel your subscription at any time through your Apple ID settings:

  1. Go to Settings > [Your Name] > Subscriptions
  2. Select CTRL
  3. Choose "Cancel Subscription"

Upon cancellation, your subscription will remain active until the end of the current billing period. You will not receive a refund for the remainder of your current subscription period.

4.5 Refunds

We grant refunds within 7 days of the original purchase. Refund requests are subject to Apple's refund policies. To request a refund, please contact Apple Support directly. We do not process refunds directly as all payments are handled by Apple.

4.6 Free Trials

We may offer free trial periods for new subscribers. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the then-current subscription price.

4.7 Price Changes

We reserve the right to change subscription pricing at any time. Price changes will not affect your current subscription period but will apply upon renewal. We will notify you of any price changes in advance.

5. User Content and Ownership

5.1 Your Content

You retain all ownership rights to the content you create in CTRL, including your goals, vision statements, task data, progress logs, and achievements ("Your Content").

5.2 License to CTRL

By using CTRL, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the service to you. This license terminates when you delete your content or your account.

5.3 Data Portability

You have the right to export Your Content. Contact us at contact@tryctrl.app to request a copy of your data.

6. Prohibited Uses

You agree not to:

  • Use CTRL for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the service, other users' accounts, or connected systems
  • Use any automated means (bots, scrapers, etc.) to access the service
  • Interfere with or disrupt the service or servers
  • Transmit any viruses, malware, or harmful code
  • Impersonate any person or entity
  • Reverse engineer, decompile, or disassemble any part of the App
  • Remove or modify any copyright, trademark, or proprietary notices
  • Use the service in any way that could harm minors

7. Intellectual Property Rights

The CTRL App, Website, and all related content, features, and functionality (including but not limited to software, design, text, graphics, logos, and the task catalog) are owned by CTRL and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

8. Disclaimers

8.1 Not Medical or Health Advice

CTRL is a personal development and goal-tracking tool. It is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The App does not provide medical, health, or therapeutic advice.

Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you read or track in CTRL.

8.2 Not Professional Counseling

CTRL is not a substitute for professional therapy, counseling, or mental health services. If you are experiencing mental health issues, please consult with a licensed mental health professional.

8.3 Results Not Guaranteed

While CTRL is designed to help you track and achieve your personal goals, we make no guarantees about the results you will achieve. Your success depends on your own effort, commitment, and circumstances.

8.4 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, secure, or virus-free. We may modify, suspend, or discontinue any part of the service at any time without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CTRL, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your access to or use of or inability to access or use the service
  • Damages resulting from any conduct or content of any third party
  • Unauthorized access, use, or alteration of your content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless CTRL and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your Content

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through an in-app notification at least 30 days before the changes take effect.

Your continued use of CTRL after the changes take effect constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the service and may cancel your subscription.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of CTRL shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at contact@tryctrl.app. We will attempt to resolve the dispute informally within 60 days.

13.2 Arbitration

If we cannot resolve the dispute informally, any dispute arising from these Terms or your use of CTRL shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except as modified by these Terms.

The arbitration will take place in California. You and CTRL agree to waive the right to a jury trial and to participate in a class action.

13.3 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the service.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CTRL regarding the use of the service and supersede any prior agreements.
